These are the terms of service between you (“Buyer”) and Simplified Privacy regarding Simplified Privacy’s SMS Exchange App.
Simplified Privacy will provide Buyer with access to Simplified Privacy’s SMS Exchange App (“the App”). The App will enable Buyer to obtain a phone number (“Phone Number”) and an SMS confirmation code from a third party (“Seller”) to enable Buyer to use Phone Number to register an account or service with a website.
The App will provide Buyer with a SMS confirmation code following Buyer’s attempt to register for an account or for a service on Buyer’s selected website. If Buyer is not successful with his (or her) registration, he may make up to two additional registration attempts for no additional charge. The App will provide Buyer with a new SMS confirmation code following each additional attempt to register on the same website. Simplified Privacy’s obligation ends following transmittal of up to three confirmation codes, whether or not Buyer is successful in registering for an account or service on Buyer’s selected website.
Buyer will make one time payment of 5 euros, payable in cryptocurrency, in consideration for the ability to use Phone Number (and associated SMS confirmation code)to register an account or service with a website. Payment covers use of Phone Number for a single account or service. Furthermore, the payment is solely for the purpose of obtaining and using Phone Number; there are additional fees should Buyer wish to purchase other services,such as a VPN, proxy, or email.
Buyer acknowledges that he has up to three attempts to register for an account or service on his selected website, whether or not Buyer is successful in registering.
Buyer agrees not to use the Phone Number and SMS service for any illegal activities, as determined by the country and/or any other legal jurisdiction in which Phone Number is registered or used. Buyer acknowledges his sole responsibility for his own actions with the website account or service using Phone Number, and therefore the Buyer explicitly agrees that he assumes the risk for any illegal behavior or misconduct.
The Buyer agrees to have the App retain a record of Phone Number being registered for which account or service using a randomly generated billing ID for Buyer.
Buyer agrees to indemnify, defend, and hold harmless both Simplified Privacy and Seller from any claims, damages, or liabilities arising from Buyer’s actions with the website account or service after the confirmation is complete. This can include illegal activities, personal injury, fraud, liable, illegal pornographic materials, illegal narcotics, threats for violence, copyright infringement, or property damage caused by the Buyer.
Buyer acknowledges that Seller is providing Buyer (through the App) SMS confirmations for a website account or service. Seller and Simplified Privacy have no ability to control the social media, website account or website service registered by Buyer, using the temporarily-provided Phone Number, after the App has sent the Buyer the SMS confirmation code. After the App has sent Buyer the SMS confirmation code, only Buyer controls the account. Simplified Privacy and the Seller do not have continued access to Buyer’s account.
Buyer acknowledges he is using Phone Number to create accounts on websites and that those websites are fully responsible for enforcement of any laws and regulations.
Simplified Privacy and the Seller do not guarantee continued confirmations or access to Phone Number on an on-going basis, even if the Buyer’s future needs are urgent and critical. Therefor,Buyer agrees to disable future continued security verifications of Phone Number in the account once the initial confirmation is complete.
Simplified Privacy’s sole responsibility is to facilitate Buyer obtaining Phone Number and confirmation code. Buyer agrees that in the event Simplified Privacy is unable to fulfill its responsibility, damages will be limited to no more than Buyer’s payment (i.e., 5 euros).
Each party is responsible for retaining its own counsel for legal advice regarding the terms and conditions of this agreement.
