Note: This is a general copy for all users to preview. This data will automatically populate with the relevant phone number and date, when the seller registers with the Exchange. And will be PGP signed for the Seller to download.
This is an agreement between you (“Seller”) and Simplified Privacy regarding Simplified Privacy’s SMS Exchange App.
Seller will designate and make available a phone number (“Phone Number”) through Simplified Privacy’s SMS Exchange App (“the App”). Phone Number must be registered in Seller’s name or, if not, be a phone number for which Seller has the legal right to use. Furthermore, Phone Number cannot be a VoIP or landline phone number.
Seller agrees to allow third party under agreement with Simplified Privacy (“Buyer”) to use Phone Number to register for an account or service on a website of Buyer’s choice. In order to do so, Seller must provide Buyer, through the App, with an SMS confirmation code Seller will receive when Buyer registers to the account or service.
Seller agrees to follow instructions on the SMS Exchange website for completing the transaction.
Simplified Privacy will provide Seller with access to the App.
Simplified Privacy will pay the Seller 4 Euros, payable in cryptocurrency, upon confirmation from the Buyer (through the App) that Seller’s SMS confirmation code enabled Buyer to register with the selected account or service.
Simplified Privacy is not obligated to pay Seller if the Buyer does not confirm that SMS confirmation code enabled him (or her) to successfully register with the selected account or service. By accepting this agreement, Seller acknowledges that Buyer may not accurately report his successful registration or that the account or service may reject the registration for reasons unrelated to Phone Number or its SMS confirmation code, in which case Simplified Privacy will not be obligated to pay Seller. However, should Buyer be unable to register his account or service after three attempts (using phone numbers provided by Seller and two other sellers), Simplified Privacy will pay Seller 1/3rd of the 4 Euros payment.
Simplified Privacy will provide Seller with a PGP signed confirmation receipt for each successfully completed transaction. But not for rejected transactions
Simplified Privacy can not guarantee there will be a buyer at the time Seller wishes to make Phone Number available, in which case Simplified Privacy will not be obligated to make any payment to Seller.
By accepting this agreement, Seller acknowledges that Simplified Privacy is hereby informing him that Simplified Privacy’s agreement with Buyer includes the following terms of service:
Buyer agrees to indemnify, defend, and hold harmless both Simplified Privacy and Seller from any claims, damages, or liabilities arising from Buyer’s actions with the website account after the+ confirmation is complete. This can include illegal activities, personal injury, fraud, liable, illegal pornographic materials, illegal narcotics, threats for violence, copyright infringement, or property damage caused by the Buyer.
Buyer acknowledges that Seller is providing Buyer (through Simplified Privacy’s SMS Exchange App) SMS confirmations for various services and websites. Seller and Simplified Privacy have no ability to control the social media or website accounts registered by the Buyer, using the temporarily provided Phone Number, after the SMS Exchange App has sent the Buyer the SMS confirmation code. After the App has sent the SMS confirmation code, only the Buyer controls the account. Simplified Privacy and the Seller do not have continued access to the account.
Buyer acknowledges he is using Phone Number to create accounts on websites and that those websites are fully responsible for enforcement of any laws and regulations.
The Buyer agrees to disable future continued security verification of the phone number in the account once the confirmation is complete. Simplified Privacy and the Seller can not guarantee continued confirmations or access to that specific phone number on an on-going basis, even if the Buyer's future needs are urgent and critical.
Simplified Privacy’s confirmation receipt upon successful completion of the transaction will provide Seller with undeniable and reliable time-dated evidence that Seller should not be held responsible for potential illegal actions of Buyer after the SMS confirmation code has been sent.
Seller acknowledges that internet based numbers, such as VoIP, will result in more frequent registration rejections, and therefore less payments.
Seller further acknowledges that Simplified Privacy reserves the right to refuse Seller from future transactions if, at Simplified Privacy's sole discretion, Simplified Privacy deems Phone Number to be of lower quality for account or service website registrations. However, in that event, Simplified Privacy will still be obligated to pay Seller for any successfully completed transactions.
Simplified Privacy is registered with XMRBazaar. Simplified Privacy and Seller agree to settle any disputes that might arise under this agreement by the XMRBazaar arbitrator. The parties acknowledge that the Bazaar is responsible for compliance with any laws and regulations governing the dispute resolution.
Each party is responsible for retaining its own counsel for legal advice regarding the terms and conditions of this agreement.
Simplified Privacy cryptographically signs this with PGP. For:
